Please read the terms and conditions regarding any interactions with our products, services, websites, or other features. Your continued use of our websites affirms that you agree to these Terms.
Shalamar Media LLP d/b/a Shalamar is a publishing company and writing advocacy organization. We provide services for writers as well as physical and digital items for sale to be used and enjoyed by our customers. These Terms and Conditions will govern the use of those services and products, our websites including this one, and any other user experiences Shalamar may generate unless otherwise noted.
Shalamar is headquartered in New Orleans, Louisiana, USA and is subject to the laws of that city, state, and country.
Be Nice Or Leave
At Shalamar, we take the practice of Decent Human Behavior seriously. No form of harassment, whether directed toward other Users or toward Shalamar principals, agents, or contractors, will ever be allowed. If you choose to use tough language with any Shalamar-related person, we may choose to discontinue service to you, with or without issuing refunds. Be considerate and measured toward others and this clause need not ever be enacted.
All products sold by Shalamar are provided as is. Our refund policies allow for treatment in certain cases, such as files corrupted before being sent or books damaged on our end. Please familiarize yourself with the specific refund policy for each product you purchase.
Some products may be listed as out of stock and may not be delivered for weeks or months. This is particularly true of our hardcover books, which do take a long time to print. When this happens, you may purchase the product to ensure that it will be delivered to you once the current production cycle is complete. By using our websites, you affirm that you understand this. Shalamar will endeavor to note which products are affected by these cycles and when the next batch of the product will be available for sale or shipping, but we are not required to do so and may not from time to time.
Payments are handled through Stripe or PayPal and are subject to the respective company's terms. Shalamar does not have access to your financial information, including but not limited to credit card numbers, bank balances, or other transactions. No offline payments will be accepted without prior arrangement. If you would like to make a purchase using something other than a card or PayPal, please contact us first. Offline payments made without prior notice will not be honored and may be returned.
Shipping is handled via FedEx or UPS and is subject to the carrier's terms and their capacity to deliver at any given time. This is wholly outside of Shalamar's control. If you happen to be located in or near New Orleans, you may use the Shipping Opt Out feature and arrange a time to pick up your products in person. If you are outside the Greater New Orleans area and select Shipping Opt Out, you will be expected to arrange your own shipping or pickup of your products. Shalamar will not ship products for which the Shipping Opt Out feature was selected.
Customers can choose to create accounts at our Store, but this action is absolutely not required to make a purchase. In the case of these accounts, Shalamar has no access to passwords or other data contained within the accounts. We cannot reset your password, so please store it safely and securely.
Sale and Performance of Services
The services offered on this website under "Schedule Services" or "Advertising" come with a 24-hour cancellation policy. No refunds will be issued within twenty-four (24) hours of the service's scheduled start date, including if the service was begun immediately upon receipt of payment. No refunds will be issued if the service is already in execution or has been completed. No refunds will be issued in any case if the services were discounted by fifty (50) percent or more than the standard service price as listed on our websites, and partial refunds of fifty (50) percent of what was paid will be issued for services discounted between twenty-five (25) percent and forty-nine (49) percent.
Discrimination and Violation Of Rights
Anyone can access and purchase Shalamar's products and services. We do reserve the right to discontinue services or terminate access to our websites and products should we find that a User is applying our products and services in violation of laws or personal rights or in a discriminatory manner. This may include but is not limited to requesting services on a manuscript that contains harmful or offensive language or treatment toward groups or individuals, the use of any of our offered products to uphold discriminatory views, and any other use that does not comply with Shalamar's image, supported causes, or policies. This clause will be applied solely at the discretion of Shalamar, and we may apply it with or without explanation and with or without issuing refunds.
Partners, Resources, and Other Outbound Links
The Shalamar trade name, the Shalamar bird logo, and all other company imagery found on our websites are the property of Shalamar, and all rights are reserved. You may not copy any text or use any company image for any reason. (The images found on our index pages and on the Schedule Services page were sourced from a public-domain photography website and are not owned by us. Their use is subject to the terms of their original creators.) Users of our websites are not allowed to post any type of content to our websites in any manner whatsoever. Please don't attempt it.
Standard Conditions Of Use
By continuing to use our websites, products, and services, you affirm that you will refrain from doing the following:
- Altering the websites, products, or services to deliver harmful computer programs or any type of malware or spyware;
- Breaking into or violating our websites to obtain personal information belonging to Shalamar or to our customers;
- Interfering with the proper, efficient workings of our website;
- Presenting yourself as a representative of Shalamar without express permission;
- Sending spam or otherwise unwanted information to our Users;
- Advertising to or soliciting our Users without express prior permission;
- Any other activity that is illegal according to our Policies or the governing laws we abide by according to jurisdiction.
Liability Limitation and Disclaimer Of Warranties
(This is the part that's usually in all caps when you read a T&C document, but we're not particularly keen on screaming at you.)
Shalamar does not guarantee or warrant that the products or services we provide will be error-free or that our websites will always perform at an optimal level. Our products, services or websites may be unavailable at times due to faults or maintenance. All products and services are provided "as-is" and "as-available." No warranties are offered, whether explicitly or implied (unless you are in a jurisdiction that does not allow the exclusion of implied warranties). We may change or stop offering our products, services, and websites at any time, with or without sending notices via email. The "Last Updated" date at the end of this policy statement will be kept accurate whenever changes are made to the document.
We reserve the right to end any User's ability to purchase our products, use our services, or access our websites at any time, with or without providing notice or explanations. Any questions about such terminations, or communications in general about our policies, may be emailed to email@example.com.
